Case Report — Documentation

Type of persecution

Accusation

  • Multiple and deliberate issuing of false medical certificates (mask exemptions) in at least 22 cases
  • Non-compliance with the pandemic hygiene concept in the practice
  • Not wearing a mask during a demonstration in Basel, at which I appeared as an official speaker.
  • Excessive use of public space during several walks on some Monday evenings in the period from March to May 2021

What actually happened?

  • In my professional life as a physician, I have never issued a false certificate; in the case of the 22 reported cases, I followed my medical conscience and the Declaration of Geneva.
  • My protection concept was the best in all of Switzerland and prevented much suffering and harm: in the practice: no masks, no PCR tests, no mRNA injections.
  • It is completely nonsensical to wear a mask outdoors to prevent the spread of infection, especially since the mask officially offered no protection against viruses.
  • I merely stood up for my constitutionally guaranteed fundamental rights: freedom of movement, freedom of assembly, freedom of expression, etc.

Current Status

  • Acquittal after first-instance hearing on 23.08.2024 before the Luzern district court. Acquittal then on 30.08.2024. Legal effect then in November 2024, after the prosecution decided not to appeal after all.

  • But now the moral certainty of having done the right thing (important as a wet shaver who has to look at himself in the mirror every other day)

  • Occasional messages of solidarity

Press reactions

  • In my experience, the press played the role of “agitator” and drove the authorities before them.
  • Every time after a corresponding report in the regional or national media, a registered letter from the authorities would arrive.
  • It was about the targeted defamation and smearing of those affected.

Outlook

Based on my medical ethics, I could not have acted any differently.

I am glad that I resisted the fascism that also took hold in Switzerland in March 2020.

In July 2020, I founded the association ALETHEIA – Medicine and Science for Proportionality. For the past 1.5 years, I have been working with PanaCeHa to establish a humane and holistic health model in the Swiss healthcare system.

I am grateful for what happened to me and what it has made of me!

Chronology

September 2020:
Beginning of the defamation of my person by the media (“Blick”, Luzerner Zeitung, SRF, various online portals). Letter from the cantonal physician: “Covid-19: Notice regarding medical professional duties” dated 09.09.2020
20.01.2021 to 27.01.2021:
Closure of my practice by the cantonal trade inspection for not wearing masks in the practice. Fee CHF 842.-
January 2021:
“Rundschau” segment on Swiss television SRF under the title: “When will the authorities finally take action against the lying doctors.” My complaint for defamation and violation of personal rights was not admitted for prosecution by the responsible public prosecutor’s office.
10.02.2021 to 15.06.2021:
Revocation of the license to practice => prohibition of professional practice.
21.01.2025:
Conclusion of the supervisory proceedings without further disciplinary measures.
07.10.2020:
Police interrogation regarding the accusation of repeated and deliberate issuing of false medical certificates (mask exemptions); the complaint was filed by the cantonal physician
09.02.2024:
Interrogation by the public prosecutor’s office
23.08.2024:
Court hearing before the Luzern district court
28.0.82024:
Verdict by the presiding judge: acquittal on all counts, the prosecution announces an appeal, the judge must draft a detailed verdict
28.11.2024:
Acquittal is confirmed by the prosecution; the proceedings end with my acquittal
23.01.2023:
Conviction for my protection concept in the practice: CHF 3620.-
29.12.2021:
Penal order for violation of the regulations on the use of public space of the City of Luzern (multiple counts); colloquially: going for walks in the City of Luzern: CHF 3000.-
22.06.2022:
Conviction to pay a fine of CHF 100.‑ for not wearing a mask during a demonstration in Basel on 07 November 2020: CHF 505.35.-
