Dismissal of proceedings upon payment of a €6,000 fine
Case Report — Documentation

Type of persecution

  • Criminal prosecution by the state
  • Search of practice premises

Accusation

Issuing incorrect health certificates:
18 mask exemption certificates and 2 vaccination incapacity certificates issued without personal examination

What actually happened?

I personally examined all patients and issued the certificates on the basis of medical findings. The certificates corresponded to my medical conviction and the Geneva Declaration.

— Dr. med. Daniel Beha

Current Status

  • Criminal proceedings dismissed under §153 upon payment of a €6,000 fine. For reasoning, see below.
  • Ongoing hearing proceedings before the Medical District Association Oberpfalz. For charges, see below.
Impact — Documentation

Financial impact

Legal costs of €2,000. Fortunately I had legal expenses insurance; otherwise legal costs would likely have been €30,000 – €50,000.

Collegial reactions

I have little contact with local colleagues; one colleague from Amberg attended all four hearing days at my side as a trial observer.
At every hearing, at least a dozen of my patients were present as spectators; they were searched like criminals upon entry.

Press reactions

The local press prejudged me and reported completely one-sidedly and untruthfully.

Outlook

A reckoning with the Corona pandemic, including all the grave errors and inhumane crimes, has so far not taken place within the various systems and organs of our society, and although absolutely indispensable, it appears to be unwanted to this day.

Chronology

from April 2020
Issuing mask exemption certificates; vaccination incapacity certificates already issued earlier
September 2020:
Letter from the Medical District Association stating that I was listed on the MWGFD website and had supported a MWGFD appeal from July 2020
from October 2020
Vaccination incapacity certificates discontinued for self-protection due to very high demand.
Patients who, due to their conscience or personally experienced vaccination complications, can no longer vaccinate their children do not know where to turn. They are desperate and feel completely abandoned by our healthcare system.
February 2021:
Summons letter from the police
May 2022:
Search of practice premises; two friendly police officers took copies of the relevant patient records
July 2022:
Penalty order from Amberg judge Paintner without a hearing for 10,000 euros and 1 year on probation
January – March 2024:
Criminal trial over 4 hearing days
Verdict by Amberg judge Denk: Criminal proceedings dismissed under § 153 upon payment of €6,000
September 2024:
Letter from the Government of Upper Bavaria regarding professional supervision and my criminal proceedings
August 2025:
Hearing before the Medical Professional Association regarding possible violations
