What actually happened?

In February 2022 I received a registered letter from the Zürich Cantonal Health Office demanding that I remove alleged “false statements” from my practice website medizinfeminin.ch — coupled with the threat of supervisory consequences, expressly including the withdrawal of my medical licence.

Every single point presented on the website was supported by one or more scientific references — in contrast to the sweeping accusations and assertions of the Health Directorate. After consulting several lawyers, I nevertheless removed the texts objected to by the Office.

In January 2024 I filed an application for a declaratory ruling — on the lawfulness of the scientific texts, on the unlawfulness of the publication ban and for a substantive justification of that ban — together with a parallel data protection request for access to records and for information on data processing under the ECHR. Both applications were rejected: the declaratory application in February 2024 on the grounds of “time-barred entitlement to challenge”, the data protection request in April 2024 on the grounds of “lack of connection” with the appeal lodged in the meantime. The appeal itself was also rejected by the Health Directorate.

Outlook

The threat of supervisory consequences by the cantonal Health Office — over ridiculous claims and insinuations — left a lasting political unease in me. That is why I tried to clarify the situation in 2024, which failed. The undercurrent sense of threat has remained.
