  • Allegation: 7 mask exemption certificates and a detailed certificate for a child who suffered psychological harm from a forced test at school (see the book “Vincent. Der Fall Aurich: Vom langen Weg zum Recht in Zeiten des Unrechts” by lawyer Dr. Knoche).

What actually happened?

I personally examined every patient; the consultation with the boy even lasted an hour, but the court of first instance did not consider that sufficient.

Chronology

October 2020:
Began issuing mask exemptions for patients with medical indications.
May 2021:
Search of the practice and seizure of patient files.
Spring 2022:
Charges filed regarding the mask exemptions and the certificate for the boy who had been unlawfully and forcibly tested by the public health authority.
August 2022:
Scheduled hearing, postponed at short notice; proceedings concerning the mask exemptions discontinued.
October 2022:
Hearing concerning the certificate for the boy, fine of 7,000 euros, on the grounds that a state of health could not be certified after a one-hour examination.
December 2022:
Written grounds for the judgment; this time citing alleged contradictions in the certificate; appeal lodged.
July 2023:
Proceedings before the Higher Regional Court; acquittal.
August 2023:
Appeal against the acquittal lodged by the Federal Public Prosecutor.
September 2023:
Appeal dropped and final acquittal.
