Accusation

Issuing false health certificates under § 278 of the German Criminal Code (Strafgesetzbuch). Allegation: 30 mask exemption certificates issued without personal examination.

What actually happened?

The certificates reflected my medical conviction and were in keeping with the Declaration of Geneva.
They were not certificates regarding anyone’s state of health, but rather attestations concerning the harmful effects of masks on breathing. For these, neither a physical examination nor an underlying illness was required.
Our professional code of conduct, in § 25, also does not strictly require an examination, but rather that physicians “act with the necessary care and express their medical conviction to the best of their knowledge.”

Final-instance verdict of 29 August 2023:
90 daily fines of €50, 18 months on probation.
Probation ended without incident in March 2025.

Professional impact

November 2020: Mutual termination agreement with the medical care center (MVZ) which I had co-founded nine years earlier – signed to avoid being dismissed.
Since then I have been active privately, as described under “Qualifications” and “Special Functions” on the right.

Personal impact

A strengthening of my faith in Jesus Christ, who wanted me to enable people to breathe freely and who protected me from worse outcomes.

Collegial reactions

  • A few colleagues showed solidarity.
  • The majority, however, distanced themselves – including long-standing practice partners.

Press reactions

In November 2021, when I joined the city council, the regional daily newspaper ran the sensationalist headline “Raid on Councillor”.
The paper also reported on the court hearings, which the editor-in-chief attended in person. The tenor: false health certificates.

Outlook

Despite everything, I would do it all again. My hope is that this documentation helps make the public aware of what happened to physicians in this country – and that nothing like this is ever allowed to happen again.

Chronology

February 2021:
Search of home and practice; files seized. Conduct was relatively mild, particularly at the home.
August 2021:
Letter from the Senior Public Prosecutor in Lüneburg requesting a statement. I declined the “offer” to pay €10,500 to avoid further proceedings.
February 2022:
Indictment by the Lüneburg Public Prosecutor’s Office under § 278 of the German Criminal Code (30 counts).
April 2022:
Main hearing at Uelzen Local Court (one morning). Verdict: 120 daily fines of €70.
May 2022:
Appeal by leapfrog revision to the Higher Regional Court of Celle.
November 2022:
The Higher Regional Court of Celle overturned the Local Court ruling due to substantive deficiencies and remanded the case to Uelzen Local Court.
August 2023:
Retrial at Uelzen Local Court. 90 daily fines of €50 on probation; ordered to pay half of the court costs.
January 2024:
Letter from the medical licensing authority: medical license to be surrendered on grounds of “unreliability” and “unworthiness”. After my appeal, no further action followed.
April 2025:
“In the matter of probation, it is hereby determined that the warning shall stand without further action.” (Uelzen Local Court)
