Case Report — Documentation

Type of persecution

  • State criminal prosecution
  • Medical chamber prosecution
  • Professional ban in first instance, withdrawn in second instance
  • Limited “preliminary” professional ban, i.e. effective immediately after first instance, revoked after 6 weeks following legal challenge
  • House search
  • Account freeze / asset seizure
  • Public discrediting
  • Reputational damage through media, decline in patients due to preliminary professional ban spread through media
  • Twice picked up by police squad for “witness testimony” in trials against patients, once held in a cell
  • Violation of human dignity by being forced to wear a mask despite medical certificate
  • Twice “small practice searches”: for a single patient record each, collected by police officers

Accusation

  • Issuance of allegedly false health certificates pursuant to § 278 StGB (German Criminal Code).
  • Allegation: 4373 mask exemption certificates issued without personal examination: “I hereby confirm that wearing a mouth covering is contraindicated for medical reasons in the case of …”
  • Only account receipts were evaluated, not a single original was presented, no affected person was heard.

What actually happened?

I only certified intolerance of the mask, not a state of health. Therefore these are not health certificates. The certificates corresponded to my medical conviction, medical expertise and the Declaration of Geneva, and were thus issued to the best of my knowledge and conscience and prevented harm.

None of the criminal elements of § 278 were fulfilled.

Impact — Documentation

Professional impact

  • The practice had to be temporarily closed on 02.01.2022 due to “temporary professional ban”. This was overturned in court, the practice reopened from 14.02.2022
  • Reputational damage through media and dissemination of the professional ban therein
  • Loss of practice time due to countless summons as a witness in proceedings against patients
  • Psychological strain due to the many summons, although many cancellations could be achieved

Financial impact

  • Legal costs so far approximately €113,000
  • Decline in patients due to reputational damage
  • The bank initially wanted to terminate, but then did not do so

Personal impact

  • Post-traumatic stress
  • Therapy costs, regular sessions required

Collegial reactions

  • Partial hostility
  • Hardly any support, no open support

Press reactions

Regional and national coverage of both verdicts, disparaging and defamatory.

Outlook

I acted purely based on medical expertise, to the best of my knowledge and conscience, and kept harm away from children to seniors.

In the first instance, the public prosecutor’s office threatened to also prosecute all patients they could get hold of and thereby turn them into criminals.

Everything must come to light. Only the truth heals. I have gone through all stages of a political trial and experienced Kafkaesque scenes that no one who was not there would believe.

As long as doctors are persecuted for their medical decisions and work carried out to the best of their knowledge and conscience, there is no freedom of therapy – for anyone.

The medical chambers are also subordinate to the Ministry of Justice; in my case directly through a General Public Prosecutor bound by directives acting as chamber attorney.

Only in the context of “lawfare” as a NATO strategy for combating the plandemic can it be explained how we persecuted doctors – and their patients – are being treated. This treatment is unworthy of a constitutional state.
