Issuing false health certificates under Section 278 of the German Criminal Code (StGB).
Charge:
Issuing mask-exemption and vaccination-incapacity certificates. The penalty order of the Munich Public Prosecutor’s Office covered 23 cases.
I examined every patient personally and issued the certificates on the basis of medical findings – including COPD, asthma and anxiety disorders.
The certificates were in line with my medical conviction and with my insights from many years of engagement with the subject, with the professional code of conduct for physicians and with the Declaration of Geneva.
The regional daily newspaper reported extensively and one-sidedly in November and December 2024 – under headlines such as “Vaccine exemptions – doctor charged” and “Doctor sentenced to a fine” – without any statement from the person concerned.
Despite everything, I would of course act in the same way again. My patients have a right to an individual medical assessment, and I have the duty to give it to them.
I hope that this documentation helps the public learn what has happened to doctors in this country – and that something like this does not happen again.
