Issuing incorrect health certificates (§ 278 StGB).
In a confidential conversation, alone with me in a separate room, patients made their individual vaccination decisions – in keeping with the right to self-determination enshrined in the Hippocratic Oath and the Declaration of Geneva.
On 21 January 2022, a senior public prosecutor and a public prosecutor, together with detective inspectors and about ten police officers, some of them armed and in bulletproof vests, stormed my practice, ransacked the rooms and packed up all documents, computers, laptops and mobile phones. The practice was in full operation; some patients were receiving infusions or waiting to be examined. They were taken into one room and questioned individually. I myself was placed in my waiting room and guarded by a police officer.
The public prosecutor said to my wife: “I have just decided that I will charge you as well.” She ordered that our private home be broken open and searched; my wife offered to come along to unlock the door. In the flat everything was ransacked and the suspended ceiling in the hallway was torn down. Five days later the flat was searched again and my wife was taken away for a blood sample – which a police officer took, in front of the public prosecutor, because the doctor was too busy. My wife could no longer sleep in the flat; we moved to Dortmund, into an empty flat belonging to her brother.
In May I was arrested spectacularly in the open street in front of the flat – several police vans blocked the road – and I was taken to Bochum.
In the weeks that followed, I sold the practice’s equipment via eBay, which was later construed as preparation to flee; staff of the Bochum public prosecutor’s office posed as prospective buyers.
The practice was closed from 21 January 2022; he had to surrender his medical licence. He was unemployed.
No more income while costs continued; the landlord initially refused to agree to winding up the practice. Legal fees for two lawyers of between €200,000 and €250,000 – covered from savings and with support (including “Weißer Kranich”).
Sleep disturbances, panic attacks, a racing heart. The ringing of the phone or the doorbell triggered fright. He was able to collect the seized devices (computers, laptops, mobile phones) from Bottrop again after about 14 days.
There were no reactions from his professional peers.
A local radio station and local print media engaged in a pre-judgement – including with a statement from the public prosecutor’s press office.
